Terms of Service and Membership Agreement

Welcome to CritiqalHit!

These Terms of Service ("Terms") govern your access to and use of the CritiqalHit website ("Site"), located at https://www.critiqalhit.com/, and the services and content provided therein ("Services"). By accessing or using the Site, you agree to be bound by these Terms.

1. Membership

CritiqalHit Memberships are provided via their Patreon page and offer various membership tiers:

  • The Viewer ($1 per month): Access to all free content and newsletters. Can comment on all free content.
  • The Player ($5 per month): Includes everything in the Free Tier plus access to premium content (and the ability to comment on said content), an ad-free experience, and additional Patreon specific reward(s).
  • The Critiq ($10 per month): d Includes everything in the previous tiers, plus additional Patreon specific reward(s).

Membership fees for paid tiers are billed monthly and are processed through Patreon. Prices are subject to change, but members will be notified in advance of any changes.

To accommodate Ghost.org's Stripe integration for memberships in conjunction with Patreon to provide membership benefits here on this site, Stripe collects associated email addresses upon becoming a CritiqalHit patron to keep track of complimentary premium status applied to accounts here on CritiqalHit. Payments themselves do not involve Stripe, and as stated are completely handled by Patreon. This is what enables Critiqalhit.com to provide member status via Patreon support tiers.

ATTENTION!

To facilitate Patreon integration for membership benefits here on CritiqalHit, Stripe's services which are intrinsically tied to Ghost's core systems (beyond our direct control) are required to have your Patreon-powered benefits work here on the website. As such, there are portions of the UI that, annoyingly, we can't readily modify. One of these parts you may see when looking at your account settings. Please be aware that all membership payments are to be kept to Patreon. Membership payments made in any other way may not be refundable.

2. Member Responsibilities

Members are responsible for maintaining the confidentiality of their account information and password. Members agree to comply with all applicable laws and regulations while using the Site and to ensure that their use of the Site does not infringe on the rights of others.

3. Intellectual Property Rights

All content on CritiqalHit, including text, graphics, logos, and images, is protected by intellectual property laws. Members are granted a limited, non-exclusive, non-transferable license to access and use the Site and its content for personal, non-commercial purposes. The use of CritiqalHit's trademarks, logos, or other proprietary materials without express written consent is prohibited.

4. Warranties and Disclaimers

The Site and its content are provided "as is" without any warranties of any kind, either express or implied. CritiqalHit disclaims all warranties to the extent permitted by law, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

5. Limitations on Liability

CritiqalHit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or Services. The total liability of CritiqalHit, its affiliates, and their respective officers, directors, employees, and agents for any claim arising from these Terms or the use of the Site shall be limited to the amount paid by you for the Services in the twelve months preceding the claim.

6. Indemnification

Members agree to indemnify and hold harmless CritiqalHit, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from their use of the Site or violation of these Terms.

7. Termination

CritiqalHit reserves the right to terminate your access to the Site and Services at any time without notice for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Site and Services will immediately cease.

8. Changes to Services

CritiqalHit reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

9. Third-Party Links

The Site may contain links to third-party websites or services. CritiqalHit is not responsible for the content or practices of these third-party sites.

10. Age Restriction

The Site and Services are intended for users who are at least 18 years old. By accessing or using the Site, you represent and warrant that you are at least 18 years old.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Canada. Any legal disputes arising from these Terms will be subject to the jurisdiction of the courts of Nova Scotia, Canada.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Waiver

The failure of CritiqalHit to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14. Entire Agreement

These Terms, together with any other agreements or policies referenced herein, constitute the entire agreement between you and CritiqalHit regarding the use of the Site and Services.

15. Amendments

CritiqalHit reserves the right to amend these Terms at any time. Members will be notified of any changes.
